Terms & Conditions

Our cakes and sweet treats are made especially for each customer. These terms explain how bookings, payments, designs, changes, cancellations, collection, delivery and customer responsibilities are handled.

Your date is only considered booked once the payment required for that particular order has been received and Cape to Cake has confirmed the order.

Because most Cape to Cake products are handmade, personalised, perishable and prepared specifically for an individual customer, please check all order details carefully before completing payment.

These Terms & Conditions apply to orders placed through our website as well as custom orders, quotes, private product listings, corporate orders and other bookings accepted by Cape to Cake.

Orders & Booking

Cape to Cake products are prepared to order and production capacity is limited.

Submitting an enquiry, receiving a quotation or discussing a possible date does not by itself reserve that date.

Your booking is confirmed when: Cape to Cake has accepted the order and the payment required to secure that particular booking has been received.

Unless expressly agreed otherwise in writing, bookings are accepted on a first-confirmed, first-served basis.

Cape to Cake may decline an order where there is insufficient production capacity, insufficient notice, an unsuitable design request or another reasonable operational concern.

Quotes & Pricing

Prices depend on factors including cake size, flavour, filling, design, decoration, structural requirements, delivery, setup and other requested extras.

A quotation applies to the design and specifications described in that quotation.

Changing the size, flavour, filling, design, quantity, delivery requirements or event details may change the final price.

Quotes may have an expiry date and availability is not guaranteed until the order is confirmed.

Prices quoted well in advance for future events may be subject to adjustments where this is clearly stated in the quotation, particularly where ingredient, fuel or other operating costs change before final booking.
International corporate payments: Where a corporate client's head office is outside South Africa and payment will be made by international bank transfer, an additional charge may be added to the invoice to cover SWIFT, international transfer and related banking costs.

Payment

Unless a quotation, invoice or written booking arrangement specifically provides otherwise, Cape to Cake requires full payment before an order is confirmed.

Where Cape to Cake agrees to a staged payment, deposit or balance arrangement for a particular order, the payment schedule stated in that quotation or invoice will apply to that booking.

Payment may be made using the payment methods made available for the particular order, including:

  • Secure website checkout
  • Yoco payment facilities
  • EFT where offered
  • International bank transfer where specifically arranged for an overseas corporate client
  • A private password-protected product listing for certain custom orders

An order is not considered fully paid until the relevant funds have cleared or the payment provider has confirmed successful payment.

Checking Your Order Details

Customers are responsible for checking the information supplied when ordering, including:

  • Event date
  • Collection or delivery date
  • Name and contact details
  • Cake size
  • Flavour and filling
  • Wording, spelling and ages
  • Theme and colour requirements
  • Delivery address and venue details
Please check names, dates and spelling particularly carefully. Cape to Cake cannot reasonably be expected to know that information supplied by the customer is incorrect.

Handmade Designs & Reference Images

Every cake and decoration is handmade.

Inspiration photographs, Pinterest images, previous cakes and other reference images are used as design guidance. They do not create a guarantee that the finished product will be an exact replica.

Reasonable handmade variation may occur in:

  • Colour shades
  • Piping
  • Decoration placement
  • Fondant figures
  • Flowers
  • Edible prints
  • Proportions and spacing

Cape to Cake will aim to maintain the agreed overall theme, style and colour direction.

Materials, Decorations & Substitutions

Occasionally a particular decoration, flower, colour, packaging item or other component may become unavailable.

Where practical, Cape to Cake will use a suitable alternative that preserves the overall appearance and value of the order.

We will contact the customer where a proposed substitution would materially change the agreed design.

Changes to Confirmed Orders

If you need to change a confirmed order, please contact us as soon as possible.

Whether a change can be accommodated depends on:

  • How close the request is to the event date
  • Whether ingredients or decorations have already been purchased
  • Whether production has already begun
  • Whether additional time or materials are required
  • Cape to Cake's production schedule

Additional charges may apply to approved changes.

Cape to Cake cannot guarantee that changes requested close to the event date can be accommodated.

Cancellations & Refunds

Most Cape to Cake products are prepared specifically for an individual customer and may be personalised, perishable or made to the customer's specifications.

Cancellation and refund requests are therefore considered with reference to the nature of the order, the notice provided, work already performed, ingredients and decorations already purchased or prepared, and applicable law.

Concerns With an Order

If you believe there is a problem with an order, please contact Cape to Cake as soon as reasonably possible after collection or delivery.

Photographs and information about the condition of the product may be requested so that we can properly assess the concern.

Depending on the circumstances, Cape to Cake may also request that the affected product or remaining portion be retained for inspection.

Contacting us promptly makes it much easier to determine what happened and, where appropriate, find a reasonable solution.

Collection

Collection is by arrangement from Cape to Cake in Bellville, Cape Town, unless another arrangement has been confirmed.

The person collecting the order should arrive at the agreed time and provide a vehicle suitable for safely transporting the cake.

For safe transport: Cakes should normally travel on a flat, stable surface in a cool or air-conditioned vehicle. A car seat or passenger's lap is generally not a suitable surface for transporting a decorated cake.

Once a collected product has been handed over, any subsequent transport, handling, storage or environmental exposure is outside Cape to Cake's direct control.

Delivery & Setup

Delivery may be arranged through Cape to Cake's delivery arrangements and is charged separately unless expressly included in the product or quotation.

Delivery prices depend on factors such as distance, order size, cake structure and whether venue setup is required.

Customers must provide accurate venue, recipient, access and contact information.

Where a venue has restricted access, loading procedures, security requirements or specific setup times, these should be communicated to Cape to Cake in advance.

Cake Care & Storage

Cakes contain ingredients and decorative materials that may be sensitive to heat, sunlight, humidity, movement and incorrect storage.

Customers and venues should follow any storage, handling and serving instructions provided by Cape to Cake.

Damage caused by transport, handling, heat, direct sunlight, unsuitable storage or other conditions arising after handover may not be attributable to Cape to Cake, subject always to applicable consumer law.

Wedding & Tiered Cakes

Wedding cakes require additional planning, structural preparation and scheduling.

Cape to Cake recommends finalising wedding cake orders at least two months before the wedding date, subject to availability.

Tiered cakes use appropriate internal support systems and cake boards for stability.

Very tall, heavy or structurally complex wedding cakes may require mandatory venue delivery and setup. Where this applies, the cake cannot be collected by the customer.

For cakes requiring venue assembly, individual tiers may be transported separately and assembled at the venue.

Delivery and setup charges are quoted according to the specific venue and cake.

Stands, Toppers & Additional Decorations

Cape to Cake is a bakery and does not provide event furniture or cake stands unless a particular item has been expressly agreed in writing.

Cake toppers, laser-cut decorations, MDF toppers, acrylic toppers and similar items are not automatically included with a cake unless the product description or quotation specifically states that they are included.

Optional extras may therefore carry an additional charge.

Fresh Flowers & Florists

Where fresh flowers are included in a cake design, the responsibilities of Cape to Cake, the customer and any external florist depend on who is supplying and placing the flowers.

Customers and florists supplying flowers should provide varieties suitable for use around food products.

If flowers are supplied by a customer or external florist, Cape to Cake is not responsible for the quality, freshness, identification or pesticide history of flowers supplied by that third party.

Allergens & Ingredients

Cape to Cake's kitchen handles common allergens including gluten, dairy, eggs, peanuts, tree nuts and soy.

Although reasonable care is taken when preparing products, Cape to Cake cannot guarantee a completely allergen-free environment because products are made in a shared kitchen.

Customers should tell Cape to Cake about relevant allergy concerns before ordering.

Cape to Cake uses halal ingredients. This describes the ingredients used and is not a representation that the business itself holds formal halal certification.

Non-Edible Components

Depending on the design, cakes may contain structural or decorative components that are not edible.

These may include:

  • Dowels
  • Internal supports
  • Cake boards
  • Flower picks or barriers
  • Wires
  • MDF or acrylic toppers
  • Other decorative items

These items must be removed as appropriate before the cake is cut or consumed.

Customer-Supplied Images, Logos & Artwork

Customers may supply photographs, logos, names, images, artwork or other material for edible printing, corporate branding or custom designs.

By supplying such material, the customer confirms that they are authorised to provide and use it for the requested product.

Cape to Cake may refuse material that we reasonably believe is unlawful, inappropriate or unsuitable for reproduction.

Photographs of Our Work

Cape to Cake may photograph completed cakes and treats for business records, portfolio use, our website or social media.

Where a cake includes clearly identifiable private information or a personal photograph, privacy considerations will be taken into account before public use.

Promotions, Discounts & Special Offers

Promotions may be subject to additional product-specific conditions, including order dates, collection periods, availability, quantities or excluded upgrades.

Unless expressly stated otherwise, promotions and discount offers cannot automatically be combined.

Promotional pricing applies only during the period stated for the relevant promotion.

Events Outside Our Reasonable Control

Occasionally circumstances outside Cape to Cake's reasonable control may affect an order.

Examples may include:

  • Serious illness or emergency
  • Significant power, water or infrastructure failure
  • Severe weather or road closures
  • Major supplier failures
  • Government restrictions
  • Other events that could not reasonably have been prevented

If Cape to Cake becomes unable to fulfil an order, we will communicate with the customer as soon as reasonably possible and deal with amounts paid in accordance with applicable law and the circumstances of the order.

Responsibility & Consumer Rights

Cape to Cake is responsible for providing products and services in accordance with applicable South African law and the material specifications agreed for the order.

Cape to Cake cannot reasonably control what happens to a product after it has been collected or handed over, including later transport, handling, venue movement, storage, exposure to heat or weather, or alteration by another person.

Personal Information

Personal information provided in connection with an order is processed in accordance with Cape to Cake's Privacy Policy and applicable data-protection requirements.

Electronic Communication

Customers may receive order-related communication by email, telephone or another communication method used during the booking process.

Electronic records such as website orders, payment confirmations, emails, quotes and invoices may form part of the order record.

Customers should ensure that the contact details supplied to Cape to Cake remain accurate.

Questions, Complaints & Disputes

If you have a concern about an order, please contact Cape to Cake so that we can investigate and attempt to resolve the matter.

Nothing in these Terms prevents a consumer from making use of any applicable statutory complaint or dispute-resolution process.

These Terms are governed by the laws of the Republic of South Africa.

Updates to These Terms

Cape to Cake may update these Terms & Conditions as our products, services, operating procedures or legal requirements change.

The latest version will be published on this page together with the most recent revision date.

Terms applicable to an already-confirmed order will also be interpreted with reference to the quotation, invoice, product listing and other information agreed for that particular booking.

Make sure the event date, size, flavour, filling, personalisation and collection or delivery information are correct before confirming your order. If anything is unclear, contact Cape to Cake before completing payment.
